Our duties

We are required by law to keep your protected health information (PHI) private, to give you this notice of our legal duties and privacy practices, to follow the terms of the notice currently in effect, and to notify you if a breach of your unsecured PHI occurs.

How we use and disclose your health information

Treatment. We use and share your information to provide your dental care, for example with a specialist we refer you to, a dental laboratory, or a pharmacy filling a prescription.

Payment. We use and share your information to bill and get paid, for example by sending claims to your dental or medical insurance plan.

Health care operations. We use and share your information to run our practice, for example to train staff, review the quality of care, and send appointment reminders.

Business associates. Companies that perform services for us, such as our scheduling, billing and IT vendors, may receive your information. They must sign an agreement to protect it.

Other uses and disclosures we may make without your written authorization:

  • People involved in your care or payment for it, such as a family member or a child's parent or guardian, unless you object
  • As required by law, including federal, state or local law
  • Public health and safety, such as reporting disease, preventing a serious threat to health or safety, and reporting suspected abuse, neglect or domestic violence as the law requires
  • Health oversight activities, such as audits and licensing inspections
  • Lawsuits and legal proceedings, in response to a court order, subpoena or other lawful process
  • Law enforcement, for purposes the law allows
  • Coroners, medical examiners and funeral directors
  • Organ and tissue donation
  • Research, when an approval process the law requires has been met
  • Specialized government functions, such as military, national security and protective services
  • Workers' compensation, as the law allows
  • Disaster relief, to help notify family about your location and condition

Uses that need your written authorization

We will get your written permission before we:

  • use or share your information for marketing
  • sell your information
  • use or share psychotherapy notes, if we hold any

Any other use or disclosure not described in this notice needs your written authorization. You may revoke an authorization in writing at any time; this stops future uses and disclosures, but not those already made in reliance on it.

Substance use disorder treatment records

If we receive records from a substance use disorder treatment program covered by federal law (42 CFR Part 2), we will not use or share them, or testimony about their contents, in any civil, criminal, administrative or legislative proceeding against you unless you give written consent or a court orders it after giving you notice and a chance to be heard. If we ever use those records for fundraising, you will first have a clear chance to opt out.

Your rights

  • Get a copy of your records. You can ask to see or get a paper or electronic copy of your dental and billing records. We will respond within 30 days and may charge a reasonable, cost-based fee.
  • Ask us to correct your records. You can ask us to amend information you think is wrong or incomplete. If we say no, we will tell you why in writing within 60 days.
  • Ask for confidential communications. You can ask us to contact you in a specific way, such as a different phone number or address. We will agree to reasonable requests.
  • Ask us to limit what we use or share. You can ask us not to use or share certain information for treatment, payment or operations. We are not required to agree, except that if you pay for a service in full out of pocket, you can ask us not to share that information with your health plan, and we will agree unless the law requires us to share it.
  • Get a list of disclosures. You can ask for a list of the times we shared your information in the six years before your request, other than for treatment, payment, operations and certain other purposes. One list a year is free.
  • Get a copy of this notice. You can ask for a paper copy at any time, even if you agreed to receive it electronically.
  • Choose someone to act for you. A legal guardian or someone with your medical power of attorney can exercise your rights. For children, parents or guardians generally act on the child's behalf.

To use any of these rights, contact our Privacy Officer.

If you believe your privacy rights have been violated, you can complain to our Privacy Officer, or to the U.S. Department of Health and Human Services, Office for Civil Rights, at www.hhs.gov/ocr/complaints, 1-877-696-6775, or 200 Independence Avenue SW, Washington, DC 20201. We can change the terms of this notice, and the changes will apply to all information we have about you. The new notice will be available on request, in our offices and on our website.
